We will collect personal information in an open and transparent manner to allow us to provide a professional service to you. We collect this information in order to provide our services, maintain contact with you, keep you informed of the services we offer and current developments, provide administration and manage your client file.

If you choose not to provide us with your personal information, Kinsella Accounting will be unable to provide you with services

We generally will not collect sensitive information, however, if necessary we will gain your explicit consent to collect and use this information. 

​It is important that the personal information we hold is up to date and accurate. If you become aware of, or believe any personal information we hold is inaccurate, incomplete or out of date, please contact us.

The Privacy Act 1998 (Cth) (Privacy Act) defines types of information, including Personal Information and Sensitive Information.

Personal Information means information or an opinion about an identified individual or an individual who is reasonably identifiable:
- whether the information or opinion is true or not; and

 - whether the information or opinion is recorded in a material form or not.

If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “Personal Information” and will not be subject to this privacy policy.

Sensitive Information is defined in the Privacy Act as including information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive Information will be used by us only:
- for the primary purpose for which it was obtained;

 - for a secondary purpose that is directly related to the primary purpose; and

 - with your consent or where required or authorised by law.

We may collect Personal Information from you whenever you input such information into the Website, related app or provide it to Us in any other way.

This may include:

• Directly from you when you fill in forms (contact, onboarding, payment)

• Via payment gateways or third-party service providers when you purchase services

• Occasionally via third parties (with your consent), e.g. referral partners or authorised representatives
   

We may also collect cookies from your computer which enable us to tell when you use the Website and also to help customise your Website experience. As a general rule, however, it is not possible to identify you personally from our use of cookies.
 

We generally don’t collect Sensitive Information, but when we do, we will comply with the preceding paragraph.
 

Where reasonable and practicable we collect your Personal Information from you only. However, sometimes we may be given information from a third party, in cases like this we will take steps to make you aware of the information that was provided by a third party.

In the future, Kinsella Accounting may engage trusted contractors or service providers located outside Australia to assist in the delivery of our services, including tasks related to bookkeeping, accounting support, Xero Health Checks and administrative functions.

Where this occurs, these contractors may have access to personal information necessary for them to perform their duties. We will only disclose personal information overseas where:

• the overseas contractor has agreed to privacy and confidentiality terms that are consistent with the Australian Privacy Principles (APPs);

• the information is disclosed solely for the purpose of providing services to you; and

• reasonable steps are taken to ensure your information is handled securely and in accordance with this Privacy Policy.
  
  

At present, we do not routinely disclose personal information overseas.

However, if overseas disclosure becomes necessary, it may involve countries such as the Philippines and Vietnam, or other jurisdictions where our contracted service providers are located. We will update this Privacy Policy as required when these arrangements are finalised.

By providing your personal information to us, you consent to the possibility that your information may be disclosed to our overseas contractors under these conditions.

Kinsella Accounting takes reasonable measures and precautions to protect the personal information we hold from such risks as loss or unauthorised access, destruction, modification or disclosure. Reasonable steps are taken to destroy or permanently de-identify any personal information no longer required. 

The firm uses physical and electronic procedures to ensure the privacy of information is safeguarded. 

Please note the internet is not secure and we cannot guarantee the security of any information sent to us via the internet. 

Any personal information or content that you contribute to any social medial applications can be real, collected and used by others. Kinsella Accounting has no control over this. We are not responsible for any use, misuse or misappropriation by others of your personal information for content that you contribute. 

At any time you may request access to your personal information by contacting michelle@kinsellaaccounting.com.au. Please allow 2 to 3 business days for the firm to complete this request. Where possible Kinsella Accounting will provide you with access to the information either by returning the originals or providing copies. You will be provided time to inspect the information requested. In the situation where we are unable to provide you with access to information the firm will provide a reason why. 

If you have a complaint concerning the manner in which we maintain the privacy of your Personal Information, please contact us as on the contact details set out at the bottom of this policy. All complaints will be considered by Michelle Kinsella and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will, in consultation with you, take appropriate steps to rectify the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner.
